These Terms and Conditions explain your rights and obligations. Please read them carefully. You may have other rights granted by law and these Terms and Conditions do not affect these except if the two are inconsistent. If this is the case then these Terms and Conditions will override any other rights which you may have, unless this is not permitted by law.

Except where a specific means of communication is required by a provision of these Terms and Conditions, if you have any complaints or comments about our service or any goods you purchase or wish to contact us for any reason connected with your order you may contact us by telephone or e-mail using the contact details specified above. Communication by e-mail will be regarded for the purposes of these Terms and Conditions as being written communication.

Making a Purchase

To make a purchase from our website, add items that you wish to buy into the shopping basket. Click on the shopping basket icon or checkout button and follow instructions to add your contact, delivery & payment details to complete your order.

The Contract Between Us

We must receive payment of the total price for the goods that you order before your order can be accepted. If you have ordered by e-mail we will confirm that your order has been accepted once payment has been received by us, by sending an email to you at the email address you provide in your order form. If you have ordered by post or telephone, dispatch of the goods will constitute acceptance of your order. Our acceptance of your order brings into existence a legally binding contract between us.

Price and Payment

The prices payable are as set out in our website. You will be required to pay extra for delivery. Our delivery charges for website orders are as set out in our website. You will make payment for the order through PayPal or Global Payment.

Payment must be in pounds sterling. If you are purchasing by credit or debit card from outside the United Kingdom, place your order and your credit card company will convert the transaction to your own currency. You do not own the goods until we receive payment in full in pounds sterling.

 

Right for You to Cancel Your Order

If you order perishable food products, the Distance Selling Regulations do not apply, and you cannot cancel your contract with us for the goods. If you order goods other than perishable food products, you may cancel your contract with us for the goods at any time up to the end of the seventh working day, after the day you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

If we have not dispatched the goods within 30 days of the dispatch date stated in our confirmation of your order (or within 30 days of your order if we have not given confirmation of the order within that period) then you may cancel your contract with us for the goods.

To cancel your contract you must notify us in writing using the address or e-mail details specified in the ‘Contact Us’ page on the website. If you have received the goods before you cancel your contract then unless, as specified above, you do not have a right to cancel, you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you, and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Once you have notified us that you are cancelling your contract, any sum debited to us from your credit or debit card will be re-credited to your account or the amount of any cleared cheque payment will be reimbursed to you, in either case as soon as possible and in any event within 30 days of cancellation PROVIDED THAT the goods in question are returned by you, and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you, or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Cancellation by us

We reserve the right to cancel the contract between us if: we have insufficient stock to deliver the goods you have ordered; we do not deliver to your area; or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will endeavour to notify you (by email where your email address has been provided) and will re-credit to your account any sum deducted by us from your credit or debit card, or reimburse to you the amount of any cleared cheque, in either case as soon as possible, but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of Goods to You

We will deliver your ordered goods to the address that you provide us with when you place your order. We may deliver the goods in several consignments to the same address, but will not charge extra for this.

We will normally dispatch your goods within 2-3 business days of receiving your order. This time period, or any alternative dispatch date stated in our confirmation of your order, is indicative only and we cannot guarantee an exact delivery date.

If delivery cannot be made due to your absence at the time of delivery, you agree to pay our reasonable additional fees for redelivery. We will inform you of the cost of these fees as soon as reasonably practicable, and you will have the option of reconfirming your order including the additional fees, or cancelling your order (except in the case of perishable food products, which cannot be cancelled). If you cancel your order we will refund the purchase price of the goods, but you agree that we may retain your original delivery fee in compensation for the time and expenses incurred for the failed delivery. If we have a record of ‘attempted delivery’ from the delivery company, this is deemed proof that delivery was attempted.


If the delivery company have a signed acknowledgement of delivery, this is deemed proof that delivery was made. We cannot be held liable for the alleged loss of goods if delivery was signed for by a neighbour or other third party accepting delivery in your absence. If you ask the delivery company to leave the parcel in a specified place without a signature, we cannot be responsible if the parcel is subsequently lost, stolen or damaged.


You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase. 


Please note we only ship to mainland UK, and some exclusions apply. We will have to refund any orders that order to addresses outside of the UK.

Guarantee and Liability

Our goods are guaranteed free from material damage or defect (save for damage or deterioration occurring in the course of delivery). Although the greatest care will be made in packaging the goods, we cannot accept responsibility for damage sustained to them during the course of delivery. 


You should inspect the goods when you receive them for defect or damage. If you find any defect or damage you must notify us within 24 hours of receipt of the goods. Photographic evidence may be required. Notification should be in writing using the contact details specified above.


If we are responsible for the damage or defect, we can elect to refund the purchase price or provide replacement goods at no cost to you. If we elect to refund the purchase price or provide replacement goods we will be deemed to have complied with our obligations under the contract and no claim can arise out of your rejection of the original goods.


Packaging of goods sometimes varies to that illustrated on our website and/or in our catalogue. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of our contract with you and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.


We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing that is caused by any event or circumstance beyond our reasonable control including, without limitation, bad weather (including snow, ice or flooding), accident, strikes, lock-outs and other industrial disputes, or breakdown of I.T. systems or network access.

Substitution

Whenever you place an online order we’ll do our very best to deliver all the items you’ve ordered. Occasionally, when goods are out of stock or otherwise unavailable, we’ll offer substitutes. We choose substitutes very carefully and offer what we believe is the most appropriate alternative to the product you’ve ordered. Cheese will be of similar size, blend and flavour. If we offer substitutes, we’ll make this clear by detailing them on your delivery paperwork. You can refuse the substitute by returning the product to us – we will then offer a full refund. Please note this is also applicable to products within a hamper. 

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Third Party Rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Promotional Code Usage

  1. The code must be entered at checkout to receive the offer.
  2. Some exclusions may apply.
  3. We reserve the right to end offers and promotions early at our discretion.
  4. We reserve the right to extend offers and promotions at our discretion.
  5. We reserve the right to change the parameters of offers and promotions at our discretion.
  6. Offers and discounts cannot be added retrospectively to an order.
  7. For offers that require a promotional code, only customers who have been sent the code may redeem the offer.
  8. More than one offer cannot be added to the basket at checkout unless specified.
